Q: Can i sue my lender for not following FHA rules, policies and guidelines? Not on title and i lost everything!
Our mortgage even says Tenants in Common. Not married nor blood related. I was supposed to be on title. Now im being evicted on an unlawful detainer. I have paid 100% of all mortgage and 100% pf all improvements for the past 9 years. I signed everything..note security instrument, our mortgage application even states title will be held in both our names. Judged ordered her possession. She hasn't worked in 9 years and got everything. I have 3 minor children in the house and won custody and jurisdiction over all of them. My lender wont help me and turns me away. Im stuck on loan and i can't live there. Im not a co signer. It says borrower. I need help!

A: The lender isn't doing anything wrong if you're not on title but on the loan. That is YOUR error to go and fix and figure out what happened years ago why the title company, not lender, didnt put you on title when they drafted it. Maybe make a claim on your title insurance if there was an error in the docs and get a new deed. The rest is family law and a judge can absolutely award her possession and you still pay for it; but that is a family law issue.
