South Gate, CA asked in Civil Litigation for California

Q: If witnesses for plaintiff, pro se, want their names kept confidential to defendent who has lawyer, it's confidential

Their lawyer told me he couldn't keep that info from his client. I have a wage claim waiting for a hearing date. I'm trying to settle. I live and work for a small motel. I filed a wage claim for minimum wage. He has a lawyer. I have 7 people who lived here at the motel during the dates of the claim, 5 still live here. They will testify the days hours and work I did as they saw it. But they don't want the owner or managers to know, they're afraid of Retaliation. I told the lawyer that, I gave him their names n numbers to call. He said he couldn't keep that info from his client.

A: The general rule is that witness information is not confidential. However, there are potential ways to keep identity information confidential depending on the circumstances. You should contact a lawyer if you are truly concerned about retaliation for other current employees.
