Q: I’m 18. 19 in may. She’s 16. 17 in October. We think she’s pregnant. Can I go to jail?
A: The Illinois Criminal Code provides that a person commits criminal sexual abuse if that person commits an act of sexual penetration or sexual conduct with a victim who is at least 13 years of age but under 17 years of age and the person is less than 5 years older than the victim. Depending on circumstances, it could be a Class A Misdemeanor, A Class 4 Felony or a Class 2 Felony. Without knowing a lot of facts beyond those set forth in your question there's no way to predict whether you might go to jail.
