Q: Hi, I have an automobile accident question...
In late 2017, another driver ran into my car. This same driver asked me not to call the police and because she appeared to be quite nice; I foolishly agreed not to call the authorities. We exchanged information that day and before I could get home, the other driver had called both her and my insurance company claiming that she was sitting still and I ran into her. Luckily, both insurance companies agreed that the other driver was at fault. So, her insurance company paid for the repairs on my car and provided me with a rental. The other driver's insurance company also offered to pay for the repairs on her damaged vehicle as well but, the couple opted for paying out of pocket. In January 2018, the other driver's husband hired an attorney to sue me and my insurance carrier---per his wife, I am to blame for the accident. My insurance company says they will retain an attorney for me.
I'm in Georgia. Can the other driver's insurance company reimburse them in order to stop the madness?
A: First you may have a counter claim. Talk to a member of the Ga.Trial Lawyers Assn--they give free consults.
