Villas, NJ asked in Bankruptcy and Real Estate Law for New Jersey

Q: Chapter 13 modification hearing postponed ! Why did I have to call the Trustee's office to find this out ?

I called the Trustee's office and spoke with one of the paralegals who told me that my Chapter 13 loan modification hearing was postponed until May 23rd, 2018. Shouldn't my lawyer have told me this ? The Trustee's office sent a email to my lawyer and he in return sent one to me stating, you don't listen I told you to put your house up for sale ! ME: WHY ? In case the loan modification doesn't go through ! If you don't like what I am doing you can seek other council. That really made my confidence in him hit a brick wall. I could see it not going through making $24,000, but the new job pushes my income over $60,000. I just don't get it ! And in Jan. 2019 I will turn 60 and be able to apply for a portion of my deceased wife's SSDI. She worked for 35yrs. before she passed away from lung cancer. All I want to do is pay my mortgage and the repayment plan and get on with my life ! Am I missing something here ? I hired my lawyer to help save my home, not sell it ! ! ! Any help or ideas ?

A: You need to seek an independent second opinion as to the status of your case before you make any decisions.
