Q: What does the serving of work or school training vouchers and my workers comp Is still not settled.

Is the insurance company trying to get me just to accept the vouchers and not proceed to trail

A: No, you can still provide to trial. If you have some level of permanent disability and your employer is not able or willing to provide modified work, the insurance company is required to send the Supplemental Job Displacement Voucher. The Voucher does not effect any of your other workers' compensation benefits (medical, temporary disability or permanent disability).

The Voucher can be used to obtain $6,000.00 worth of retraining benefits (books, tuition, etc.). You can also submit the voucher to receive a cash payment from the State of California. You can apply for the cash payment at http://www.dir.ca.gov/RTWSP/RTWSP.html

A: Is the insurance company substitution a Job Displacement Voucher for something? NO. Job Displacement Vouchers come from the adjuster INDEPENDENT of an offer to settle or an award at trial (if there is no agreement to settle). The Settlement or the Award (at trial) is based on the Permanent Disability findings of the either the AME, the QME or the Treating PHysician. The Job Displacement Voucher is based on a physician writing that you can no longer safely perform all of your pre-injury job duties (with no permanent work restrictions) and the employer did not create a new position matching your new permanent work restrictions.
