Q: I rented an apartment two years ago. My daughter just turned 18. Can she now be listed as an adult on 72 hour notice?
She is on the original agreement as a person occupying the apartment. Not sure if the landlord realizes she is now 18, but am expecting a notice for non payment next month.
A: Technically, if she is not a co-signer and only an approved occupant, a 72 Hr Notice should just be addressed to the signer of the lease (not that also listing her is likely to invalidate it though) because it is a notice to pay the rent or get out. If it is not timely paid, however, then any eviction lawsuit will likely include her name as an occupant being sought to be evicted as well, and that could end up meaning that she would have an eviction on her rental record. That in turn could make it quite difficult for her to rent anywhere for at least 5 years - not a good way to start out if she is only 18 and prospective landlords are already likely to be wary of renting to someone so young.
