Q: Received letter 2day from Git-R-Done Productions,Lawyers telling me 2 change my comp. name or else from Git-R-Done Limo

I received letter today from Git-R-Done Productions Inc , Lawyers telling me 2 change my company name or else be sued from Git-R-Done Shuttle & Limo to another name. Really how can someone own a word

A: This production company is owned by the comedian, Larry the Cable Guy who has trademarked the phrase "Git-R-Done" in a variety of different classes. If they happen to own the trademark in the class which would include limo/shuttle services, then they have a right to demand you cease and desist use of the phrase in connection with your business, as it creates confusion with their mark. With that said, if they don't own trademark rights in this class, you have reasonable justification of use if you've been in business for some time and developed your own consumer recognition. The easiest/cheapest thing to do, is to comply and use a different business name, but if you're already committed, then you might have a legitimate defense and right to use the name -- I'd advise consulting an attorney -- if you would like assistance, feel free to email me at: jason@altviewlawgroup.com
