Jersey City, NJ asked in Criminal Law for New Jersey

Q: I am on probation in PA, live in NJ and got a new charge for simple assault but was not arrested would my p.o. find out

I am very scared because in PA a rule on my probation states that I cant be around the guy I assaulted on my first charge. But this time he and I were charged in NJ for simple assault on each other. We were not arrested but only charged and fingerprinted. I don't know what to do because if I tell her she will be upset with me and if she finds out on her own by doing a background check I will still be in trouble. I went to court in NJ for this charge and pleaded guilty but I'm working on changing the plea to not guilty and will have a lawyer help me fight the charge. I guess what I'm asking mainly here is will my p.o. find out about this charge through the system or does she only look at charges in PA?

A: You need to speak with a PA lawyer about this. But it will show up on your criminal record.

A: In Jersey usually PO wouldn't violate you for a misdemeanor which is what a simple assault in Jersey is (disorderly persons offense) especially if you have a good relationship withe the PO, however, if there are other violations while on probation such as no contact or restraining order violation then that would increase your chances of getting violated.
