Thibodaux, LA asked in Adoption and Child Custody for Louisiana

Q: Can a non-biological father go to court for rights in Louisiana if he has raised the child as his own since birth?

He was told the baby was his and he signed the birth certificate, (they were never married), then found out less than a year ago through a paternity test that he was not the father. The real father I don’t believe is involved and the child believes he is his dad. The mother is controlling his life and threatens to not let him see the child if he doesn’t do what she says, since he has no rights. The child is 2. Doesn’t seem fair for a parent to ask someone else to raise a child who is not biologically theirs but then have stipulations to the involvement. Thanks for the help.

A: If they were not married and he not the biological father, he can only get parental rights by filing for custody. On the other hand to avoid child support, he has to Disavow. He can do either by hiring a family lawyer
