Q: Can my husband’s past arrests affect my green card petition?
My husband is American and he has a long history of arrests (52 to be exact) which I had no clue about. He doesn’t have any convictions for sexual abuse (I’ve heard that would automatically prevent one from petitioning) but he has a restraining order for domestic violence from his ex wife. He also has marijuana possession, drunk driving and resisting arrests. Most of this
happened when he was younger.
We wanted to start the green card process but we were told that all his records
would probably get my green card petition denied. Is this possible? I have no records at all.
A: Unless any of his convictions are under the Adam Walsh Act, his convictions will not affect his ability to sponsor you for a green card.
A: Those in and of themselves should not. The government is more interested in your record than his.
