Q: Can my husband prevent me from leaving the state to get away from him and his mistress?

We've been married for 16 years and and four kids together. Five years ago I found out he had an affair and just recently had a child with this woman who is a few months older than our youngest. Their entire relationship is on display on Facebook and when I found out they both blocked me from being able to see. When I confronted him, he's threatened to call the police and say he has recordings of me threatening harm to him and I will lose everything and go to jail. He's verbally abusive and has gotten physical a few times but I never called the police. I want a divorce and want to move to another state away from him, but feel he may retaliate against me. I'm confused about what to do in this situation, especially concerning the children I have with him. Please help

A: He can try to prevent you from taking his children out of state. You need a family law attorney who can follow the statutory requirements to relocate and file a protective order to.prevent physical violence. Do NOT threaten him. He can record any conversations you have.

A: He can't prevent you from moving, but you have to follow Louisiana's relocation statute to move the children out of state.
