Q: How to get copy of deceased mother's Living trust after her death? The successor trustee (my brother) will not furnish.

Mother died, said all of her estate would be split equally between my brother and I. He has given me part of inheritance but refuses to give me a simplified report of any kind of what was in the trust and I don't think that I have received my proper portion. Do I need to file a claim thru Probate Court even though estate did not pass thru the Court?

A: If the trust was established in Ohio, then you are entitled to a copy of the trust and a full accounting.

A: If you are a named beneficiary of the trust, then send your brother a letter requesting a copy of the trust and all financial documents. If he refuses, then you can file with the court. You can try that yourself or use the Find a Lawyer tab and retain an attorney where the brother lives to assist you.
