Q: Can I be compensated for being false imprisoned by my county for 13 days because they messed up on paperwork?
I went to prison after surrendering my probation for DWS which had a 4 yr. Back up and a misd DUI which had a 6 month county back up. Prior to going to prison I had 314 days in on these charges. After surrendering my probation I went to DOC and two days prior to being released the DOC told me my county was coming to get me because i owed them time. My county came and picked me up. For over 13 days I continued to ask what was going on.. how much time do I owe.. And could never get an answer except that they were waiting on paperwork from the court. In the meantime I missed my sons 16th birthday and valuable time with my mom whom is on hospice. After 13 days they released me and said they were sorry they never should have came and got me from prison. This isn't the first time my county has pulled crap on me and gotten away with it. I believe this all stems from an incident in 2005 where an officer assaulted me and was charged resulting in a 2 yr loss of his license to be a cop.
