Q: I am a landlord in Portland, Oregon. What percentage can I increase rent annually without incurring relocation costs?

For 15 years I made only cost of living increases which now do not cover expenses and with new Portland laws I’m not sure how to increase rent to cover them without incurring thousands of dollars.

A: Relocation assistance payments are not required due to rent increases so long as the rent increase is less than 10% over a 12 month rolling period. The notice of increase must be served no less than 90 days before the increase is to take effect; must contain the required information; and be lawfully served. You also must include a notice of the tenants rights and obligations and the eligible amount of relocation assistance with each and any termination notice, rent increase notice, and/or relocation assistance payment. You also must comply with the Portland Housing Bureau administrative rules, including sending a copy of any relocation assistance exemption letter to the tenants at the same time as applicable notices are sent to the tenant.
