Q: How far back does an apartment rental management company go when doing a Criminal background check?

A: It will get every conviction in your background that is in the database that is searched, regardless of how far back the conviction was (except juvenile convictions would not appear). It is possible that the landlord searches for CA, while the conviction might be in another state and the conviction would not show up.

A: The Fair Credit Reporting Act (FCRA) allows felony arrests to be reported on background checks for seven years after release from prison. Felony convictions can be reported as far back as the employer chooses to go.

California does not allow the use of any case older than seven years whether there was a conviction or not.
