Q: My 5YO has always lived with me. Her father and I dated, but never married.
He gives me money each week, but not through court. We are both married to different people now, and her father has never asked about us going to court. My husband is about to be an active duty soldier and I intend to move with him on post. Do I need the permission of the 5YOs dad as long as I assure she continues to visit when possible? He is going to be informed about the situation entirely, but still doesn't want to court because he knows he will have to pay back child support.
A: You can't do things on the side, without the Court being involved. You don't have to follow the child relocation act if paternity AND visitation has never been established in Court.
