Q: If your summoneds to court do you have to testify against your spouse?

My frined was involed in a higspeed chase with law enforcement. She was the passanger and the driver was a friend along with her minor daughter the driver lead police on a chase then jumped from the car leaving the 2 behind. She jumped to the driver seat and stopped the car and jumped out and tryed to tell the law what happened they acted as if she was the driver she became scared and told them the drivers name but didnt know hos information they told her to tell them and she gave them her husband infor her husband is now being accused of this even tho there is no proof putting him there that day they never found him or anything she thought they would catch the driver and know it wasnt her husband and everythin would be ok. Its not the law is now telling her they know it was her husband they seen him but on that day they ask her why she was driving way putting so many people lives at risk and ask if she had drugs if thats why she was running. What can she do to fix this.

A: In Kentucky, a spouse may not testify against another spouse unless one spouse is the victim of domestic violence of the other spouse. In the scenario above, your friend cannot be compelled to testify against her husband.
