Q: What are the obligations of the husband, who is the sole provider? What are my rights as a wife of U.S. citizen?
I got married February 2018 to U.S. citizen. Me and my daughter, (from my previous relationship) came to NY holding K1 & K2 visas last December 2017. Our visas have expired last March 2018.
And now my husband refused to:
1. setup a bank account for me, I have no regular allowance, he controls the spending, I have no credit/debit cards of my own. He is only giving me between $40-100 whenever he wants to. I asked him for money but it only ignited an argument.
2. he doesn't want to help me to get my driver's license,
3. he refused to help me and my daughter to get our Social Security Numbers,
4. he refused to file for our Adjust of Status application and said that his responsibility is done.
My husband denies that he is being financial abusive to me. He is a Senior High School Teacher in public school here in NY and very protective of his status, as he wants to retire in the next 2 years and can't wait to get his retirement pay and move to Greece where he has a house.
A: You are in a tough position since your husband refuses to sponsor you for a green card. Schedule a consultation with an immigration attorney to discuss your situation.
A: This could be the basis for an application under the Violence Against Women Act. Your husband is holding you hostage, which is a form of abuse. We recommend that you consult with an immigration attorney.
