Q: Court hearing for Loan modification coming up !

My first lawyer told me to sign a paper which was a deal he made with the investor's lawyers to give me six months to sell my home. In the meantime I got a job that pays enough for the mortgage & the back arrears over a period of 55 months. Which I have been doing to bring my mortgage & back arrears current. But the Investor's lawyers are saying now, hold on you signed an agreement to sell your home in six months. I was already told they will have someone there to buy it so they can resell it for a BIG profit. Now that I am paying the mortgage and the back arrears can I be forced to sell my home ? In 6 months I'll get $800.00 more a month. That's $100,000 before taxes I got the new, good paying job the day after I signed that paper. Or did my old lawyer give me bad advice, he is the one that came up with this deal. The investor's lawyers are also saying, I still don't have enough money to pay my mortgage. The mortgage co. is the ONLY creditor I owe ! Anyway out of this ?

A: Have your new lawyer look at it but you can likely avoid selling your house especially if you can prove your first lawyer had a conflict of interest with your creditors. You may be able to simply dismiss your bankruptcy and foreclose action by your creditors.

You have options. Talk to your attorney, and if he cannot fix your issues to get you what you want, go to a bankruptcy attorney that also understands foreclosure law.
