Richardson, TX asked in Car Accidents for Louisiana

Q: A complete stop at a subdivisiont A car approaching me with blinkers on and did not turn. I got hit and a citation.

The person obsolutely did not pay attention. I was talk of a blinker is on it is OK to turn. The person also has a relative that handles insurance. Another came that had nothing to do with the person that hit me. The trooper talked to the person who hit me and the person that showed up. The Trooper shortly talked to me and spent more time with the person who hit me. I get the citation for failing to stop and verge with the traffic. The citation he made a lot of errors, especially what he was going to right, he crossed out the first rule I broke and gave me the most expensive reason. The Trooper was not there and no witnesses. I know I had the right of way because I would have gone, but the blinker was on I say for about 20ft away. I thought the person was turning in to my neighborhood. Is there a case or just pay the fine and feel like a criminal. I admit when I am wrong, but my heart, mind, and soul say I am right

A: If you're stopped at a stop sign, you have the responsibility to ensure the way is clear from any other drivers having the right of way prior to proceeding into the intersection. You can't assume that someone with a turn signal on is turning at your intersection, or that he is turning at all. One option would be to make arrangements to have the citation reduced to a non-moving violation so that it doesn't appear on your driving record. If you can't do this on your own, give me a call and I'll see what I can do to help.
