Q: I purchased 3 plots - 1 paid in full, 2 on contract. I tried to terminate the contracts due to financial difficulty.
I was told that I could terminate 1 contract and apply the funds to save the other contract. I asked if I could terminate the contract that is paid in full for a full refund. I was told that the cemetery policy do not allow refunds. I asked to speak to the supervisor and was given the run around. When I found out who the GM was, I made contact and was told that I could not get a refund. After explaining my hardship. The GM took over 3 weeks to review my contracts before letting me know that I could use the funds to save the other 2 contracts. I asked for a contact person who could help me resolve this issue? I was asked to give more time to review the contracts and I would be contacted. To no avail. I called the GM back who decided to give me a refund for the opening/OBC. When I got the check two weeks later it was over $200 less than what I paid. I asked if I would get a revised contract and proof of ownership? I was assured I would but to no avail. I would like to know my options ?
A:
Based on the facts provided, it seems that the seller is giving you the runaround, you have hit an impasse, and it is in your best interest to retain an attorney to assist you with next steps. You may be entitled to remedy, but an attorney will need to review the contracts, as well as all communications with the seller prior to providing you with a comprehensive evaluation of your options moving forward.
That said, I recommend organizing everything you have in your possession related to this matter, including the contracts and written communications with the seller, and consulting with an attorney individually. Many of us offer free consultations, so it will not cost you anything to obtain the opinion and guidance of an experienced professional who can tailor his or her opinion based on the specific facts of this instance.
