Q: What type of attorney do we need?
We foreclosed on some rental property of a person that we had a judgment lien on because we found out that the property was 4 years in default on its property taxes and didn't want the taxes to foreclose on the property. The owner of the rental property (who lives on the east coast) hired a licensed contractor/ friend to remove everything of value from the property including the complete interior of the mobile home, an entirely separate mother-in-law's quarters, every tree and plant, over 500' of redwood fencing, 150' of block fencing, redwood and concrete decking ect… We took plenty of pictures as the destruction progressed and when the Sheriff's were called, they could only offer little assistance. We need direction as to what type of attorney we should speak to..
A:
Hard to answer this question as much information is missing: why were the buildings, landscape and hard-scape demolished without your consent?; did you know this was happening/when did you find out?; did you check out the licensed contractor before he was hired?; can you locate the contractor who demolished the buildings; did you have a written contract from the contractor?
It sounds like this fellow ripped you off, and you should go after him (i.e. sue him) for fraud, theft, and conversion of your property. Unless the contractor has a good explanation for what he did, I think you have a good case against him. Unfortunately Nipomo is a long way from Palm Springs, CA, where I operate my practice.
Since I don't have many facts, and have not seen any documents, my analysis is only a guess. It usually takes a while to sort out all the facts. I suggest you try to find a lawyer near where the you and/or the property is located as soon as possible. I hope this has been helpful.
