Q: Father passed away and his will and beneficiary information were not in line with his wishes

When my father died his brother served as his lawyer and executor of his estate. In conversations preceeding my fathers death his wishes were made known to his brother, my uncle. Upon reading of the will all things seemed in line with what his wishes were. However, upon further review, it appears that he did not properly designate beneficiaries on his two life insurance policies. He had a $300k and $100k policy. His intention was for his wife to get the $100k and his children to get the $300k. However these designations were never verified and as a result his wife is getting the larger and his children the smaller. Is there anything that can be done with this? It seems odd that his brother and attorney would have advised it prudent for over 80% of his net worth go to his 70 year old wife rather than his children and grand children. It is difficult to understand how any attorney or financial planner could ever advise a client that this is appropriate.

A: The will and the life insurance are two separate matters.

No financial planner can tell a client who to list as beneficiaries on life insurance policies.
