Q: Awaiting legal resident status while in failing relationship

A good friend has been married for 5 years and has two sons with a man and living in upstate New York. She’s applied to become a legal resident about 3 years ago and has gotten as far as getting fingerprints and physical done for the process. She’s been in limbo for over a year now and during this time her relationship with the man has dissolved. Many arguments and I feel emotional abuse around the kids on a regular basis. If they were to separate at this point, what would become of her case? Can she still become legal? She works so hard and recently went to school for a dental assistant, I want the best for her. She already has hired a lawyer who hasn’t been helpful and not returning phone calls

A: Assuming that her husband is a US citizen, it should not take 3 years for her to become a conditional resident. She should discuss the facts of her case with an experienced immigration attorney.
