Q: Owner moved RV trailer onto my lot behind a fence after I signed lease. He stays there for days at a time. Is this legal

He designed the backyard fence to make it look like the backyard ends about 18 feet before it actually does. This creates an area that he can back his rv trailer into. He had moved the trailer when I viewed the house .And there is nothing in the lease about him staying on the property. He lives in another state, but comes to stay in the trailer when he is in Los Angeles for days at a time. Is this legal? Can I force him to stop without having to move out? He's offered to either build a higher fence (8feet) or refund my security deposit and let me move out. But I really don't want to have to move again.

A: It seems that you were not aware that the lot you rented did not include the extra 18 feet that the landlord now uses for his trailer. If that was not set forth in the lease, then it sounds like he committed fraud. However, I am not clear whether you leased a house or a mobile home or a trailer. Of the two choices he gave you, I would probably elect to leave and get your security deposit back. Then again, if you don' mind having him living in his trailer in back of the fence, then maybe you can work something out (e.g. a reduction in the rent). If you want to go to Court on this, you can argue that he deceived you by hiding the true depth of the property, and that he therefore deprived you of full use of the lot. Court is expensive, so if it were me I would move.
