Q: Dog urinated on neighbor's mailbox post. Why am I being cited?

I have an obedient dog who I take outside without a leash daily. He stays within the boundaries of my property 99% of the time. There have been occasions (if I am looking at something or did not notice right away) where he stepped about 10 feet past the property line, on the sidewalk, to urinate on the neighbor's mailbox post. He was never out of my control. I assume he smelled other dogs in the neighborhood.

Dogs walk up and down the street everyday urinating on everything adjacent to the sidewalk, so I don't see why this was a problem.

A: Your question is one concerning enforcement -- and should be addressed to your local magisterial district judge ("MDJ") when you fight the citation. Go for it. If there's inconsistent enforcement of such a citation, your MDJ just may have a problem with that . . . .
