Q: am thinking about divorce , we are both on disabled social security
we have a 14 year old daughter and our home his father gave us before we married and it is in my husbands name we have lived together since 1997 and filed taxes together since 2001 but we married in 2004 and i am wondering what i would be intitled to if we divorced he has a ira account that he fixed up after he became disabled and i am the benificurary to that right now but will he have to divide it with me since he got it after we were married
A: The house sounds like a non-marital asset since it came from his father and before the marriage. You would be entitled to 1/2 of the IRA and 1/2 of any and all other property acquired after the marriage.
