Q: CanTheft be enhanced in county court after initially receiving a citation if I already have priors and an FTA w warrant?
This was a municipal citation in a neighboring city surrounded by San Antonio. I have an active warrant with them (Balcones Heights) and am afraid of being arrested. If I was taken to Bexar county jail and if this were to go to a county court can the judge enhance this to another felony based on my priors? I now have the option to pay them in order to have the warrant lifted but am afraid of being picked up before I get the full amount together.
A: Theft cases can be enhanced to felony status regardless of the value of the property allegedly stolen if the defendant has two or more previous theft convictions. The decision to enhance charges is made by the DA, not the Judge. Warrants will remain outstanding until bonds are posted, you are arrested or the warrants are recalled by the Judge.
