Savannah, GA asked in Personal Injury for Georgia

Q: injured during training for work on 8/25/2016. Work comp or Disability? Statute of limit for both in Georgia?

I’m a Longshoreman at ILA Local Union 1414 Savannah Ga. I was injured in training while driving when steering wheel kicked.

My Union says they are not responsible even though they schedule and send members to training with our employer, Georgia Stevedore Association. via their subcontractor Maritime Safety Association.

I filed Disability Claim agnst Maritime Safety Association and they denied it.

I was treated at ER in same day. Referred to Ortopaedic and Primary Physicin with 3 days excuse not to return to work. Treated 9/6/2018 at immediate medical Physician prescribed No work until released by Orthopaedic. Followed up with Primary referred to airthooedic. Orthopedic appt 9/22/2016 diagnosis torn muscle, tendon injury , no use of right arm. Light Duty after result of MRI visit, prescribed injections, pain management and Physical Therapy. No use of right arm, Light Duty. on October 14, 2016 and have treated continually since the date of injury, 8/25/2016.

A: You should be covered but understand going against some unions can mean you get blackballed. Just sayin'

So what you do is look for an attorney that handles Longshore Workers Compensation Act cases.
