Q: I have recently moved into my mother's house in California. How do I get my name on the deed? She moved to Canada.
She's unwilling to come back due to strange things happening at our borders these days.
A: It depends on how your mother wants to handle this. Is she gifting the property to you, so it belongs to you, or are you simply trying to add your name to the deed? If the house is solely in your mother's name, and she wants to add you to the title, then your mother would have to transfer the deed to you, and your mother would be transferring to you a 1/2 interest in the property. You cannot do this by yourself. Your mother would have to fill out a Deed transferring a one-half interest in the house to you, sign the deed, have her signature notarized by a Notary Public, and record the deed in the county recorder's office where the property is located. This would take some time.
