Grants Pass, OR asked in Real Estate Law for California

Q: Do I have to write another ck to home inspector if he lost my ck n found it 8 months later

I bought a house in July 2017 gave a ck to my realtor for home inspection I never received a report I just excepted what my realtor said about the report. In March 2018 8 months later home inspector came to my house threatened to put a lien on my house if i didnt submit another ck to him. Isn't it his fault for losing the ck n now it's out dated or do I have to write him another ck

A: It is not clear who lost the check. It may have been your Realtor. Or, perhaps he cashed it himself. Have you monitored your checking account? I would call the inspector and explain the situation -- that you had already given your realtor a check for the inspection. The check is either cashed or lost. If it has been cashed, someone is defrauding you. If was not cashed, it may be lost. You need to know these things so you can question the realtor about the check and solve the mystery. You should not have to write out a second check. Did the inspector actually make an inspection? If not, he shouldn't be asking for anything. If you Realtor was reading from the report, that means he should have the Report in his file. Good Luck.
