Los Angeles, CA asked in Real Estate Law and Landlord - Tenant for California

Q: Hello. I informed my lanlord I cannot pay my rent until the 14th. I was just told to expect eviction.

I'm on a 12 month lease, never have been 2 weeks late and explained it was due to unforseen circumstances.

A: I don't know why your landlord would make such a big deal out of being a couple days later. However, many landlords (i.e. most landlords) develop a superiority complex and think they can push their tenants around. Most of the time, they end up doing stupid things. I had a lease on a Law Office for 26 years. When the landlord refused to lower the rent $400 (as he had done for other tenants), I said no. He then gave me notice. My offices were one of his best businesses. It took him months to find a new tenant, and none of them stayed for very long. He lost a lot of money by being a jerk.

I would contact your landlord by phone and ask why he will not accept a rent check that is only two days late. Maybe you can work it out with the landlord.
