Q: Can my sons father fill out a Birth Certificate/affidavit without my consent? Is hospital liable for this?
We were not married when my son was born. I was asleep and he filled out the B.C. and also the affidavit for paternity. I didn't give him the consent to do any of this as I wanted my sons last name as my last name.
A: He can execute an affidavit of paternity saying he is the father without your consent. You should talk to the hospital. The mother is the person who usually provides information like the name.
