Q: I was hit by a bus recently and the other party was determined to be at fault for the accident.
My vehicle was just declared totaled. I believe I will owe an additional $6k to pay off my loan after the insurance company gives me cash value, and I do not have gap insurance. Can I go after the bus company for the remainder of my loan, considering I was not at fault?
A:
Generally, no. They only have to pay you the value of the car. How you financed it is your business.
However if you were hurt you have a claim for your injuries and should consult a member of the NH Assn for Justice for the county where the wreck happened.
