Q: W hat is a donald advisement?

I am being charged with aggravated harassment two counts of threatening and intimidating and resisting arrest. What is a Donald advisement?

A: Donald Advisement is when the Judge tells the Defendant that a plea offer was extended in this case and after a certain date the plea will no longer be available. Typically, this occurs at a settlement conference where the Defendant, Defendant's Lawyer, Prosecutor, and Judge all meet to discuss the case and what the Prosecutor plans on presenting/proving at trial. The settlement conference is a good time to get any questions answered by the Prosecutor or Judge. All parties will be able to discuss the plea and possibly have the punishment slightly reduced. However, after the date indicated on the plea, the plea will expire and you will have to go to trial. The purpose of the Donal Advisement is to make a formal record in court that the Defendant is aware that the plea will expire on a certain day so the Defendant cannot appeal the case and claim s/he was unaware that the plea ever expired.
