Q: Do I have a case for failure to diagnose?
The ER sent me home several times in a 2 week period. Even though sufficient tests had been done to find the LG infection in my hip and as a result I went septic. Which was discovered by a different hospital. I had to have emergency surgery on my hip resulting in being unable to work unable to pay my bills and currently unable to walk unassisted. The surgery ironically was performed at the hospital that failed to diagnose me several times. And when I woke up the had the nerve to tell me how lucky I was that I came in when I did or I would have lost my leg. Anyways days later still hospitalized they came back and told me I had MRSA. I just feel that I have now had to under go unnecessary surgery had my life turned upside down basically all because this hospital was unable to diagnose an infection that was so large I was in surgery from midnight till 9 am and still required a drain to be in my hip for 3 days
A: Difficult case but you have significant damages. Suggest you get a copy of the records of the two hospitals. If they ask for a reason just say "insurance issue." Under the Electronic records Act you can get the records as cheap as $5 per disc! If they say "would you like us to print them out," don't! then you'll be charged per page!
