Q: What are my possible penalties for first dui?

My charges are vc23152(a) driving under the influence of alcohol vc23572(a) cbc spec/allege-minor passenger vc23152(b) driving under the influe over .08 BAC. There was a car in front of me and had a blinker on turning left, so I went around and passed. Cop stopped me because the car could of turned right and said it could of been my fault if he bashed into me. He smelt alcohol and ended up doing three test, my alcohol BAC was .13. I also had my daughter with me but cps was not called beings I'm a native american he allowed me to call someone to come get my daughter, which my cousin came. I then was getting ready to get booked in but I had brought up I was a diabetic and no nurse was available to check my sugar so they took me to hospital where then I was released.

the DA will ask for jail time for sure but you will not do a day in jail;

A: 2-180 days in jail, probation, fines, high risk insurance, first offender dui program, suspension of driver's license, ignition interlock.

These are all possibilities. In some counties the minimum jail term is enforced literally, and in some counties you are allowed to do all or part of the jail term on some form of alternative sentencing program. These may include community service or house arrest with an ankle monitor, etc. Most courts don't mandate an ignition interlock for a first offense, but it is within the court's authority.

From the facts that you stated, you may have some good defenses. Hire a DUI attorney right away.
