Tacoma, WA asked in Landlord - Tenant for Oregon

Q: Oregon - my landlord texted me what he used my deposit for, instead of mailing or hand delivering it, is this legal?

2 extra days to move out @ $ 22 per day

Plumber to remove toy from toilet $76.50

Labor to clean stove and fridge 3 hours @ $35 hour $105

Haul trash( items left in apartment)to dump one hour @$50 Pluss $15 dump fees

Clean apartment 4.5 hours @$35 $157

Change locks $45

My deposit was only $400, this adds up to $492.50

I took 2 extra days to get out, that's fine. The toilet was flooding a few weeks before I left, he finally came 2 weeks later with a plumber and found a piece of plastic in toilet, not a toy, but I do have kids. I didnt clean the floors/counters as he said he was completely gutting the apartment. He tore out the carpet, tore out all of the cupboards in kitchen and bathroom, he broke down a wall, he is just completely remodeling and redoing the whole apartment, which he started doing with each apartment after the tenant leaves. I gave him the key back, and he just put the next door apartments old door and old lock on my old place

A: No, not legal as to delivery. Has to be via first class mail or personal delivery. ORS 90.300(14)
