Dumont, NJ asked in Civil Rights, Juvenile Law and Criminal Law for New Jersey

Q: While police were not involved, is there a chance I will face jail time? Should I pay a civil demand for close case?

ccused for shoplifting $40 tagged item in Bergen County,NJ. LP took my license, DOB, name and age and weight. Police we’re not involved but I was given a paper for $150, I refused and was then told to contact LP department within 72 if case made. They said I should receive a letter within a week or 2. Will I simply get fined or face jail time? If i pay the fine will the case be put to rest if I also ask for a “receipt” that no further disputes will be made? I read that there is a 50% chance that if fine is not paid that legal action will take place, i don’t want anything anymore. I wish for this to be done and over with as a past.

A: Yes a chance exist for the next year that the store at anytime May file criminal charges against you. Whether they will do this is anyone's guess but arguing over the Civil demand may not be wise. Of course you would be best served by speaking with an attorney to see what your best options are but expect to pay for a consultation fee since you have not been charged and you are merely seeking legal advice.
