Q: How much notice do I give tenant when 1 year lease is up, that we want to raise his rent? How much can I raise it?

I have contacted this tenant 3 times but he hasn't responded about renewing the lease. I will renew his lease at no rent increase for 12 months. He has responded to another email & text. We do not want him to go month to month, but our Oregon form lease agreement states it will go month to month if no lease is signed. If he goes month to month and won't sign a lease, I want to raise his rent. How much notice do I have to give taking into account that he has a 12 month lease not a month to month? What is the percentage that I can raise it, is it 5% or 10%?

A: Much depends upon the exact wording of your existing lease. It presumably is able to be terminated with advanced notice before the end of the lease term. If you do not want to go month to month, simply terminate the lease at the end of the lease term and offer the tenant the option to either vacate or sign another term lease. As for rent increase, there is no limit to the amount of a raise. Once the lease goes month to month, 90 days advanced notice is required state-wide. If the rental dwelling is within the Portland city limits, you likely have other additional obligations, depending upon the details. So if you stay with fixed term leases, you simply need to enter into the new lease before the current one expires, with the new amount of rent. If the current lease expires and rolls over into a month to month, then at least 90 days advanced notice of any rent increase is required. If he is unresponsive, you simply give him a date to sign a new lease by or he is to be out at the end of the existing lease term. That should force him to commit one way or the other.
