Tillamook, OR asked in Landlord - Tenant for Oregon

Q: Can a landlord/co-tenants take a person living at the residence off a rental contract without notice

One of the co-tenants moved out in May does not pay any bills or rent but still is making decisions regarding the household he has spoken with the landlord and other co-tenant to take me off the rental agreement and put a person he just moved in (without prior notice to landlord) on the agreement the co-tenant who moved out also did not give notice to landlord when he vacated. To top it off he and other co-tenant agreed to another person to move in in May to take his place. She moved in and is now going to have to vacate as well. She had a verbal agreement with landlord to put her on agreement in the co-tenant who vacated in May place. What action do I need to take to keep myself, my son and co-tenant on the agreement. The landlord is in California I reside in Tillamook Oregon. And I believe he is not being told the whole story or the truth.i don't know what to do or who to contact to discuss if this is legal

A: I am having difficulty following the events or who is who. You don't say whether you all are on the same rental agreement or each on separate agreements or something in between. You also don't say whether this is a month to month tenancy or a fixed term lease. If a fixed term lease, what, if any, clause is in the lease regarding early termination? Regardless, IF a tenant vacates and restores possession to the landlord, he is out and should have nothing further to say about household events. His leaving likely also technically terminates the rental agreement he was on and for all others who also were on the same rental agreement. Depending upon exactly what you are renting (a house? a specific room in a house?), the landlord may or may not have the right to move others in without your express consent. Bottom line is you appear to be in a rather convoluted relationship that will need to have you carefully review it with a landlord-tenant attorney if you want to make sense out of it and understand what your legal rights may be. Good luck.
