Q: Can I have the eavesdropping upstair neighbor prosecuted?

I am currently staying with my elderly mother and she is living in a senior apartment. I have been staying with her for quite sometime to take care of her. But this upstair neighbor is constantly spying and eavesdropping on us. When my mother goes to the bathroom, I can hear him running there and just stay there while my mother is in the bathroom. And sometimes, I try to divert his attention by making some noise in the kitchen area, then he would run over to the kitchen area and stay for a while then goes back to the bathroom area where my mother is. This person is so very strange and he does this constantly. And sometimes I feel like he is peeking in through the ceiling vent in the bathroom. It would be almost impossible to do that I assume but I can't be certain whether he is really doing it or not. I tried to use the flash light on my phone camera and take pictures in hoping to scare this guy away but he won't budge.

Is there anything that I can do to have him stop this?

have you complained to the neighbor or landlord or police?

maybe hire a lawyer to ghost write a letter threatening to pursue any and all remedies at your disposal

you can go to small claims and sue for up to $10,000......but you have to prove damages.

neither of you would have a lawyer.
