Q: On Aug 1, 2016 I signed a 1 year lease for a duplex in Northern Calif. After the 1 year lease was up we went on a month to month rental. My rent has always been due the first. So on Aug. 1, 2018 I would be starting my 3rd year. On June 20, 2018 by mail and personal delivery our Prop. Manager served a 60 day notice because the landlord is planning on selling. That would make my moveout date Aug 20. We had a very large fire in my town and were evacuated for 5 days. We called property manager and ask for moving extention. We got 1 extra day, and she said by the way you have to pay the whole month of August rent.. My question is I do not believe I should have to pay the whole month when I was on a month to month and my rent was always due on the 1st. and landlord gave ME Notice of termination.
A: If I understand the facts correctly, the dispute is over the extra 10 days of rent that the landlord wants to charge you. I would think that due to the fire they should give you the extra days out of courtesy. But, my experience with landlords is that they are only interested in collecting rent. Maybe you should just move out as soon as you can, and I doubt the landlord will sue you for the extra rent he claims you owe.
