Q: What laws, cases, and motions can I use for him not to have a record or have a conviction? I need all. Answers!

My son just BARELY turned 12, and just entered middle school this past week. He has NEVER been in trouble and gets As and Bs. A girl sent him a video of herself without a shirt or bra. My son was on the bus Last week, and was scrolling and listening to music like every-day. He was scrolling through his gallery, and a student was over his shoulder, and seen the video and asked my son to send it to him. My son said OK and clicked his home button. When he went to school Monday, he was pulled from class, they held him out all day from classes and read him his rights and took hos phone. They are trying to charge him as a sex offender and a felony. He sent it through text to 1boy, that boy then posted it on the app IMO. My son is not a malicious, or even a rambunctious little boy. He is not aggressive or get into any trouble. He is in choir, he plays basketball, and barely even goes outside, we are homebodies. I NEED HELP!!! please I will not let them railroad him.

A: So sorry this happened to your family. I can only imagine how you are feeling, however, no attorney can give you a formula to take care of it yourself. The facts you provided although detailed, do not come close to the information necessary to provide a confident legal answer. I hate when lawyers just say get an attorney.... so I will give you a good reason to hire one. These charges are so serious, you need to get a competent and zealous attorney now when its early, to start advocating and conducting investigations. Remember with hiring a lawyer, although its costly upfront it provides a sense comfort and accountability that is priceless. Far too often people wait until the day before trial or motions to retain an attorney and wonder why some options are just not available to them. I don't know your financial situation but it seems like you have a good kid in a bad situation, Im sure your village can help you find counsel for such a serious case. With these facts, you can not do it by yourself. Your son needs his mom, as his mom. He also needs a lawyer to be his lawyer. I hope this helps.
