Q: At fault party left before officer arrived at scene. Can I use police bodycam recording of driver phonecall confession?
911 called for car side-swiping me on interstate. At-fault party(use JB) had already left scene when police arrived. (NOTE: at-fault party did leave me his valid drivers license, insurance policy & we exchanged confirmed phone numbers)
Once Dunwoody police officer arrived, I called JB. JB confessed to officer over the phone that he was at-fault for the accident.
Officer said that the phone call confession was recorded, just in case JB switched up his story.
I asked officer whether report needed to be written up? He said basically it was up to me & that people often times just exchange information and leave police out of it.
I decided against it, thinking the recorded conversation of admission was enough if something went wrong.
So now that JB has disputed the insurance claim of him being at fault, what is best course of action:
1] obtain recorded message from officer
2]get 911 logs
If i get this data, do I deal with his insurance company again, or small claims court?
