Q: Can I sue my employer of 18 years for emotional/physical distress due to constant manipulation, control & humiliation?
My physical & mental health has declined over the last 10 years and can be documented with doctor reports.
A: Depends on the facts. There is no cause of action (basis for suit) against an employer merely because you have mean, nasty boss. There are two potential causes of action to look for in this situation: (A) discrimination based on a protected class, such as age, race, sex, religion, national origin, etc., with the discrimination causing an adverse employment action (which can include hostile work environment or "constructive termination" - being forced to resign to escape severe harassment), and (B) intentional infliction of emotional distress, where you'd have to prove that outrageous actions were taken with the specific subjective motive of causing emotional distress, and did in fact cause severe emotional distress, usually proven by psychiatric/psychological diagnosis and treatment. There are limitations periods for each that are far less than 18 years. Consult an employment law attorney in your area.
