Q: I forgot to get my tag renewed. I got a citation. Can I fight it?
I never forgot before.
I have been driving over 30 years. Nothing, not even as much as a parking ticket.
Extremely bad year, a lot of stress. Spent my birthday depressed and crying all day. Never thought about my tag.
I have paid the late fee.
I personally know people who have gotten their tag late and just paid the late fee and others who have had the tag citation removed or know family or friend who have done so.
Being an honest person with a clean record it is really bothering me having this on my record. Is there any way to have it removed?
A: Contact the court within the time period stated on the ticket. Tell them you want to have an Informal Hearing, or Pre-trial, depending on how the ticket is written. The ticket should be marked as to if it is a Civil Infraction (CI) or Misdemeanor (Misd). There should be instructions for whichever it is attached to the ticket; follow them. as to how to contest a ticket. Then go to court when you are notified or told to come to court, and explain your situation to the prosecutor or officer or Magistrate, depending on the type of ticket it is. Be sure you take proof that you have gotten the tag renewed. You may have to pay a fine, but you may be able to avoid this going onto your driving record. Sincerely, Frank B. Ford

A: I agree with Mr. Ford. If you request a hearing and bring proof that you purchased the tags, and if your record is otherwise clean, you can ask for the citation to be dismissed, with costs, or ask that it be reduced to a different offence without points and that is not reported on your record. It would be well worth it to retain an attorney to appear with you.
