A: Assuming you are in Oregon, I am not clear about the situation. You paid July rent at the end of July and have not paid August rent? They gave you a 72 hr. notice for not paying Aug rent, on or after Aug 8th, you did not pay rent by the 72 hr. deadline, and they have now filed to evict you? IF this is accurate, then you likely have a limited chance of avoiding having your tenancy terminated. There may still be questions as to the sufficiency of the wording of the 72 hr. notice and/or it's delivery but otherwise, they may have you. IF the above scenario is in error somehow, however, then you may (or may not) have a more likely defense. They only way to really know is to gather everything and take it to a local landlord-tenant attorney for a careful review - and sooner is better than later if an eviction action has already been filed. Good luck.
