Q: Can I get custody of my ex gf son? Will the state remove him from his current home (mine) during adoption process?

I have joint 50/50 legal and physical custody of my daughter and my ex's sone lives with me and always has since he was 2. He is 10 now and even after seperation has lived with me every other week with his sister. Ex is in jail awaiting arraignment for armed robbery and has admitted to not being sober before she was arrested. She was using meth but I cannot prove this. Her son's father has been completely physically and financially absent for over 5 years. Will the state remove him from his sister, his school, and the only stable home he has ever lived in under these circumstances? I am going to get an adoption lawyer but don't want to risk him being put through anything more traumatic than what he has already been through. His father has a criminal record and a record of drugs. I have always provided and maintained a safe and stable home, no criminal record, veteran, and I am financially, emotionally, and physically capable of caring for both children
